Withdrawal from the contract by the consumer

According to the Consumer Rights Act of 30 May 2014, the buyer has 14 days from the date of receipt of the goods to send a statement of withdrawal from the contract, and the period is 12 months if the seller has not informed about the right of withdrawal.

The return of the item by the Buyer should take place immediately, no later than within 14 calendar days from the date of sending the statement, as well as the return of funds by the Seller. However, the Seller may withhold the return of funds until the item is received.

Buyers who have requested a sales document in the form of a VAT invoice with a tax identification number do not have the right of return.

Exceptions for this are sole proprietorships.

  1. The goods returned by the Buyer should be packed in an appropriate way, ensuring that there is no damage during transport. Goods are to be returned in their original packaging with complete equipment and accessories as well as documents issued at the time of sale. The returned goods must not show signs of use and must not have mechanical damage. The address for returning the returned goods is:
Garett Dział Zwrotów, ul. Targowa 18/1316, 25-520 Kielce.
  2. The products in the ‘Beauty’ category are designed for personal care and hygiene. The packaging is secured with a special protective foil or security seals. After tearing the foil or seals, it will not be possible to return the goods. Returns of products whose packaging has been opened will not be accepted (Article 38(5) of the Consumer Rights Act).
  3. The contract is deemed not to have been concluded and the consumer is liable for any reduction in the value of the item resulting from its use beyond what is necessary to ascertain the nature, characteristics and functioning of the item.
  4. The Buyer bears the costs of direct return of the goods to the Seller in connection with the withdrawal from the contract without giving a reason within 14 days from the date of delivery of the goods.
  5. If the Buyer has chosen a method of delivery other than the cheapest usual delivery method offered by the Seller, the Seller is not obliged to reimburse the Buyer for the additional costs incurred by him.
  6. In the event of damage to the goods during transport, a damage report should be drawn up. It is necessary to contact the courier company to do this, therefore the Buyer makes an appointment individually with the courier to prepare a damage report. The report should be prepared up to 7 calendar days after receipt of the parcel. A scan of the damage report should be sent along with the return form to the following address: [email protected]
  7. The Buyer is liable for the reduction in the value of the item if the goods returned by them are damaged or show signs of being used in a manner exceeding what is necessary to determine the nature, characteristics and functioning of the item. In this case, the Seller assesses the reduction in the value of the item in the percentage range from 1% to 99% and is obliged to reduce the amount of the refund by the amount of their claim related to the reduction in the value of the item.
  8. The return of mutual benefits should be made immediately, but no later than within 14 days of withdrawal from the contract.
